Subject: 9592/City Code/5-16 & -17/Beer Board Date: Mon, 7 May 1990 15:16:00 -0500 ORDINANCE NO. 9592 AN ORDINANCE TO AMEND PART II, CHATTANOOGA CITY CODE, SECTIONS 5-16 AND 5-17, SO AS TO ABOLISH THE PRESENT BEER BOARD AND ESTABLISH A NEW ONE. SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Section 5-16, Part II, Chattanooga City Code, be and is hereby repealed, the present five (5) member beer board is abolished, and a new Section 5-16 enacted in lieu thereof as follows: "Sec. 5-16. Established. There is hereby established a board of nine (9) members, to be known as the "Beer Board of Chattanooga." SECTION 2. BE IT FURTHER ORDAINED, That Section 5-17, Part II, Chattanooga City Code, be and is hereby repealed and a new Section 5-17 inserted in lieu thereof as follows: "Sec. 5-17. Term; filling vacancies; chairman and secretary. (a) Each of the members of the beer board shall be appointed from separate City Council districts so that each district is represented by a resident thereof. The members of the beer board shall be appointed by the Mayor, subject to confirmation by the City Council. Employees of the City shall not be eligible for appointment to the beer board. (b) The members of the beer board shall be appointed so that they shall hold office for staggered terms. The members appointed from districts 6, 8, and 9 shall be initially appointed for one (1) year terms. The members appointed from districts 3, 4, and 5 shall be initially appointed for two (2) year terms. The members appointed from districts 1, 2, and 7 shall be initially appointed for three (3) year terms. (c) After the initial appointments, terms of all members shall be for three (3) years. All members shall continue to serve until their successors are appointed. No person shall be eligible to serve more than two (2) consecutive terms. (d) In the event of a vacancy on the beer board, the Mayor, subject to confirmation by the City Council, shall fill the same for the remainder of the term and each new appointee shall be a resident of the district of the vacant seat. (e) The beer board shall organize and select its own chairperson, vice-chairperson and secretary." SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two (2) weeks from and after its passage as provided by law.
